Enko Group’s (Enko) Austral Handles, Aluminium Extrusion Handles and Handle Free Solutions products (products) are sourced from reputable suppliers. Enko warrants that the products are of acceptable quality in accordance with their product specification and the Consumer Guarantees Act 1993. We warrant that the products are free from any defects in workmanship and materials for a period of 15 years from the date of purchase subject to limitations below.
This warranty extends to the purchaser or first end-user and will not extend to, nor may it be assigned to any subsequent user or purchaser of a product.
LIMITATIONS
The above warranty shall not apply to the following:(i) Failure of a product due to incorrect installation or failure to follow fitting instructions or use of a product in a manner for which it was not designed.(ii) Failure of a product due to abuse, misuse or accident, or any failure due to dismantling, alteration or repair by any person not authorised by Enko.(iii) Failure of product due to incorrect maintenance, failure to adhere to recommended maintenance procedures.(iv) Fair wear and tear of product.(v) Cost of removal, reinstallation and freight of product.(vi) A product has been moved from its place of installation.
CLAIMS
All warranty claims by a purchaser or first end-user must be made in writing to Enko and include the warranty card originally sent with the product. The claim must be approved by Enko before any cost is incurred . Enko shall at its sole discretion credit, repair or replace any product to be defective and in breach of this warranty. Where Enko replaces any product, it will endeavor to replace the product with an identical product or if not possible with a similar product.
LIABILITY
Enko makes no other warranty of any kind expressed or implied in respect of the products. Enko’s sole responsibility is to repair or replace a product subject to a valid warranty claim.
Enko will not be liable for indirect, incidental, or consequential costs or damages, including removal or installation costs, loss of operations or profits (whether direct or indirect), to the maximum extent permited by law.
Nothing in this warranty is intended to limit any condition, warranty, right or Remedy available pursuant to New Zealand law including the Fair Trading Act 1986 and the Consumer Guarantees Act 1993, except to the extent permitted under such legislation.
Where products are acquired for the purpose of a business, any terms implied by any consumer protection legislation shall have no force and effect, to the extent permitted by law, between Enko and the purchaser or the end user.
